Federal High Court Dismisses ₦50bn ExxonMobil Oil Spill Claim, Upholds Oil Pipelines Act
In a landmark ruling, the Federal High Court in Uyo has dismissed a ₦50 billion compensation suit against ExxonMobil. The court found no legally recognisable wrong committed by the oil company and ruled the case incompetent. The judge held that Section 11(5) of the Oil Pipelines Act provides the exclusive remedy for pipeline-related claims. Attempts to pursue common-law negligence and nuisance actions were struck out for failing to follow the statutory compensation procedure. The decision relied heavily on a Joint Investigation Visit report, which showed the alleged spill was contained within ExxonMobil’s facility and did not affect surrounding communities or fishing areas. The absence of evidence on livelihood or economic damage also weakened the plaintiffs’ case. Legal experts say this judgment reinforces the primacy of the Oil Pipelines Act and may set a key precedent for future environmental and pipeline litigation in Nigeria’s oil-producing regions.
