Flawed Electoral Act Could Hand 2027 Polls to the Courts, Warns Ex-INEC Commissioner

A former INEC commissioner warns that unless key sections of the Electoral Act are amended, Nigeria’s 2027 elections risk serious manipulation and a loss of credibility. He highlights three dangerous provisions. Section 63 allows presiding officers to accept unsanctioned ballot papers. Section 138 grants immunity for ignoring INEC directives. Section 137 shields election officials from scrutiny in petitions. These gaps shift the battleground from polling units to courtrooms. Politicians could exploit ad hoc staff vulnerabilities and apply political pressure on judges. Widespread litigation would undermine voter confidence. He urges INEC and the National Assembly to repeal these provisions immediately. Strong laws, committed officials and a viable opposition are essential to safeguard Nigeria’s democracy.
