Court of Appeal Nullifies El-Rufai Judgment Over Unfair Hearing

The Court of Appeal in Kaduna has set aside the Federal High Court’s July 30, 2024 judgment in former governor Nasir El-Rufai’s rights enforcement suit. The appellate panel found that El-Rufai was not properly served with a hearing notice, breaching his right to a fair hearing. The lower court had proceeded on July 18 without notifying him and refused to allow him to reply to the respondents’ counter-affidavit. The Court of Appeal ruled that these fundamental flaws robbed the trial court of jurisdiction. The judgment has been declared a nullity. The case will return to the Federal High Court for a fresh hearing before a different judge.
