SERAP and Editors Challenge NBC’s Broadcaster ‘Gag Order’ in Court
The Socio-Economic Rights and Accountability Project and the Nigerian Guild of Editors have filed a suit at the Federal High Court in Lagos. They are contesting a Formal Notice from the National Broadcasting Commission that threatens sanctions on stations and presenters for airing personal opinions. The plaintiffs argue that key sections of the 6th Edition of the Broadcasting Code are overly vague and breach freedom of expression guaranteed by the 1999 Constitution and Nigeria’s human rights commitments. They want the court to declare those provisions null and void. They are also seeking an interim injunction to stop the NBC from imposing any sanctions until the case is decided. Led by human rights lawyer Femi Falana (SAN), the action warns that the Notice could chill media voices ahead of the 2027 elections.
