Court of Appeal Upholds Injunction Restraining ADC Caretaker Committee
The Court of Appeal has affirmed an interim order from the Federal High Court that bars INEC from recognising state congresses organised by the Senator David Mark-led caretaker committee of the African Democratic Congress. In a 2–1 split decision, the appellate judges found no grounds to set aside the April 29 injunction. They also upheld the restriction preventing the caretaker leadership from interfering with the tenure and duties of elected state executives. While this decision is a procedural win for the faction challenging the David Mark committee, it does not resolve the deeper dispute over who legitimately leads the party. The substantive case will determine that question at a later hearing.
