Lagos Chief Judge’s Surprise Recall of Land Dispute File Raises Fairness Concerns

Lagos Chief Judge’s Surprise Recall of Land Dispute File Raises Fairness Concerns

A sudden move by the Lagos State Chief Judge to withdraw a long-running land dispute case without notifying the claimants or their lawyers has stirred controversy. During proceedings at the Ikeja High Court, Justice Akin Savage announced that the case file was recalled by the Chief Judge, offering no explanation or timeline for its return. The dispute, between Nasco Town Limited and Mr Abiodun Ariori alongside the late Chief Michael Cole’s family, involves a Senior Advocate of Nigeria and dates back to 2020. Counsel for Nasco and Chief Anthony George-Ikoli have petitioned the Chief Judge for clarity, arguing that parties deserve to know the reason and status of the file. Nasco Town Limited has also raised concerns about possible external influence. The company outlined its uninterrupted possession of the land since 1978 and questioned why only the defendants seemed aware of the recall. Both petitions now demand transparency to safeguard public confidence in Lagos’s judicial process.

This sounds unfair, but maybe the judge had good cause we're not privy to yet. Let's not jump to conclusions.

Lawyers representing the claimants should immediately request official clarification and consider filing a motion challenging the surprise recall for lack of notice.
