How Parties and Agents Should Enforce Instant Result Transmission in the Ekiti and Osun Elections

Candidates and their agents must prepare to enforce Section 60(3) of the Electoral Act 2026 in the upcoming Ekiti and Osun polls. The law mandates that once a Presiding Officer finishes transmitting results from the BVAS at the polling unit—openly and without delay—those figures must appear immediately on the IREV portal. If results do not show up right away, agents should record the polling unit name and ID. INEC must then explain the delay at election tribunals or face cancellation of that unit’s result. The only acceptable excuse is a proven communication failure. INEC must establish what happened and why, or those polling units risk nullification. The era of waiting for ward officers to approve uploads is over.
