Court of Appeal Upholds ₦10M Judgment Against David Mark-led ADC, Affirms State Executives’ Tenure

The Court of Appeal in Abuja has dismissed the appeal by the Senator David Mark-led faction of the African Democratic Congress. It affirmed the earlier Federal High Court ruling and awarded ₦10 million in costs against the appellants. The majority judgment held that the national caretaker leadership had no authority to dissolve duly elected state executives. Such actions were found to violate Section 223 of the Nigerian Constitution and specific articles of the ADC Constitution governing party democracy. The appellate court confirmed that only elected state committees may organize state congresses. It also barred INEC from recognizing any congresses conducted by caretaker committees appointed outside the party’s constitutional framework. This ruling resolves a major leadership dispute in the ADC and reinforces the supremacy of party constitutions ahead of preparations for the 2027 general elections.
