U.S. Prosecutor Accused of Fabricating Evidence and Intimidating Witnesses in Dr. Henry Abdo Case

U.S. Prosecutor Accused of Fabricating Evidence and Intimidating Witnesses in Dr. Henry Abdo Case — 1 of 2
1 / 2

A series of complaints allege that Assistant U.S. Attorney Jonathan Bailyn abused his power in the case against Dr. Henry Abdo. He’s accused of impersonating an FBI agent to threaten witnesses and failing to disclose critical discovery documents. Despite telling the court he provided all evidence, Bailyn reportedly withheld years of accounting records central to Abdo’s defense. He also made false statements about Abdo’s visa status to keep him detained and misrepresented the legitimacy of Abdo’s humanitarian initiatives. The most serious charge is that Bailyn falsified the factual basis in the plea agreement, violating Federal Rule of Criminal Procedure 11(b). Critics say this “cowboy tactic” subverted Dr. Abdo’s right to a fair trial and undermined the integrity of the justice system.

Does anyone think fabricating evidence to intimidate witnesses could trigger wider reforms in how federal prosecutors are held accountable?

I'm not convinced these allegations alone will lead to any meaningful discipline without a judge first finding misconduct.

Lawmakers should consider clearer rules requiring prosecutors to disclose all investigative documents before trial to prevent similar abuses.
