Engineer Appeals ₦152m Judgment in Lagos Property Dispute with Oak Homes
A Nigerian-American engineer has filed a nine-ground appeal at the Lagos Division of the Court of Appeal. He is challenging the June 15, 2026 High Court ruling that his ₦152 million luxury apartment purchase agreement with Oak Homes Multinational Services was extinguished by novation. The High Court had dismissed his counterclaim for specific performance and ordered Oak Homes to refund the purchase price. The engineer argues the trial judge misapplied contract law, ignored material evidence, and wrongly placed the burden of proof on him instead of the developer. In the appeal, he asks the court to restore and enforce the original sale agreement, compel Oak Homes to complete and deliver the two Victoria Island apartments, and grant damages. He also contests the novation finding based on Supreme Court precedent and insists that specific performance is the proper remedy for land contracts.
