Delta Assembly Vacates Udu Lawmaker’s Seat After APC-to-NDC Defection

Delta Assembly Vacates Udu Lawmaker’s Seat After APC-to-NDC Defection

The Delta State House of Assembly has declared the Udu State Constituency seat vacant after Hon. Collins Egbetamah resigned from the APC and joined the NDC. The decision followed a unanimous motion citing Section 109(1)(g) of the 1999 Constitution, which stipulates that a legislator who defects forfeits their seat. Speaker Emomotimi Guwor directed the Clerk to notify INEC and request a by-election under Section 116(2). The House Leader presented evidence and read Egbetamah’s resignation letter confirming his defection on April 30.

What do you think about the Assembly's decision to vacate Egbetamah's seat after his switch to the NDC?

Do we know which provisions of the law allow the assembly to strip a member's seat after switching parties?

It seems the unanimous motion leaned heavily on Section 109(1)(g) to justify removing a defector from office.

I'm not convinced switching parties automatically invalidates a lawmaker's mandate, especially when voters didn't get to weigh in first.

Maybe a clearer constitutional amendment or legislative guideline is needed to handle party defection and avoid these sudden seat vacancies.
