US Jury Holds Uber Liable After Driver Allegedly Groped Passenger

A federal jury in North Carolina has ruled that Uber is liable for a driver who allegedly grabbed a passenger’s inner thigh and asked if he could “keep her” with him during a trip. The panel awarded the plaintiff $5,000 in damages in the third bellwether trial against the company. Previous cases include an $8.5 million verdict in Arizona and a not liable finding in California. Uber says it will appeal the battery finding, arguing its drivers are independent contractors and that liability instructions were incorrect. U.S. District Judge Charles R. Breyer applied North Carolina’s common carrier laws to hold Uber responsible for passenger safety. More bellwether trials are scheduled across the U.S. as plaintiffs continue their broader lawsuit strategy.
