Electoral Act Bars Courts from Intra-Party Disputes, Imposes ₦10m Penalties – Femi Falana

Human rights lawyer Femi Falana (SAN) warns that under the new Electoral Act 2026, Nigerian courts cannot grant interim injunctions in internal party disputes until final judgment. He highlights Section 83, which empowers INEC to monitor party activities and demand clarifications. Parties that fail to comply face fines of up to ₦1 million. Falana explains that any suit filed on intra-party matters will attract a minimum cost of ₦10 million against both the plaintiff and the lawyer at the end of proceedings. Judges must withhold interim rulings and hear these cases on an accelerated basis. He says the measures aim to curb frivolous litigation and reinforce INEC’s regulatory oversight of political parties.
