Malami Moves to Overturn EFCC’s Interim Asset Forfeiture

Malami Moves to Overturn EFCC’s Interim Asset Forfeiture

Former AGF Abubakar Malami has filed an affidavit at the Federal High Court in Abuja, challenging the EFCC’s interim order to seize multiple properties. He insists all assets were lawfully acquired through his decades of legal practice and business investments. Malami argues the anti-graft agency failed to present any prima facie evidence linking the properties to criminal proceeds. He also accuses the EFCC of inflating asset values and carrying out seizures without a final court order, claiming due process was breached when family members were evicted and documents confiscated. In his defence, Malami detailed legitimate income streams, including bank loans, book launch earnings, and declared investments. The court will now decide whether the properties will be permanently forfeited or returned to him, testing the limits of EFCC’s asset forfeiture powers.

What evidence might Malami present to show his assets were legitimately acquired through decades of legal practice and investments?

Right. He could show audited bank statements, proof of investment returns, and fee invoices from his law practice.

Could he share specific documentation, like bank statements or property purchase records, to trace each asset's legitimate origin?

It's striking how interim asset forfeiture orders often stay in place despite ongoing challenges, potentially leaving properties idle for months.

Are we overlooking EFCC's mandate to recover illicit proceeds, rather than assuming every seized asset is lawfully owned by Malami?
