Court Affirms Every Nigerian Voter Can Challenge INEC’s Presidential Results
A Federal Capital Territory High Court in Maitama has upheld that any voter can challenge the Independent National Electoral Commission’s transmission of presidential election results. Presiding Judge Peter Kekemeke ruled on INEC’s preliminary objection that the court had jurisdiction to hear the case brought by Ephraim Okoye, an eligible voter who alleged incorrect or missing results from his polling unit. Okoye asked for a declaration that INEC failed to transmit accurate results for Finance Quarters 1, Wuye, Abuja, on February 25, 2023. He also sought an order to replace the false server data with the correct form EC8A, N50 million in damages, and a public apology in two national dailies. Rejecting INEC’s claim that Okoye lacked standing, the judge emphasized that every voter has a right to hold the commission accountable and safeguard the integrity of Nigeria’s electoral process.
