The US Supreme Court has ruled that nearly everyone born on American soil remains a citizen under the 14th Amendment. Justices rejected a presidential order that sought to limit birthright citizenship to children of lawful permanent residents only. The decision preserves a constitutional rule established after the Civil War to protect the rights of all persons born or naturalized in the United States. ACLU attorney Cecilia Wang argued that the Amendment’s clear text and history guarantee citizenship at birth. The Trump administration had asked the court to interpret “subject to the jurisdiction thereof” as excluding children of parents without permanent legal status, but the court declined to adopt that narrower reading. The ruling upholds a landmark precedent set by United States v. Wong Kim Ark and maintains the principle of unconditional citizenship for most US-born individuals.
