Lagos Court Orders Remand of Seriously Ill Defendant Despite Medical Orders

Lagos Court Orders Remand of Seriously Ill Defendant Despite Medical Orders

Justice A.T. Muyideen of the Lagos State High Court ordered the remand of Hammed Tajudeen Akanbi at Ikoyi Correctional Centre despite his critical condition. Akanbi has been under treatment at the Police Hospital for over two weeks and was brought to court in an ambulance on oxygen support. He was unable to step into the courtroom, yet the judge directed that he be remanded pending arraignment. A subsisting order had permitted Akanbi to stay in a police medical facility, and his legal team received the charge sheet and proof of evidence in court. The presiding judge dismissed the medical report and refused to hear from the attending doctor. When officials of the correctional centre later examined Akanbi, they deemed him unfit for custody and refused admission. A dispute ensued between police and prison staff, and his current whereabouts remain unknown. The matter is adjourned to July 3, 2026.

Should the court have waited for full recovery before ordering remand given his critical condition and ongoing treatment?

It's surprising that medical orders from Police Hospital were set aside despite clear evidence of his need for continued care.

Lawyers should consider petitioning higher court for temporary relief when health risks outweigh custody orders in cases like this.
